Os Direitos Humanos nas relações internacionais: proteção das vítimas e recuperação de ativos

Abstract

O tema da presente dissertação é o direito das vítimas de crimes, sobretudo de tráfico de pessoas, a serem compensadas pelos danos sofridos à luz dos direitos humanos, do direito internacional público e das relações entre Estados. Pretende-se caraterizar a natureza desse direito, analisar o seu enquadramento normativo internacional, as relações entre os Estados no assunto, identificando eventuais entropias e formas de as superar. Tentar-se-á perceber se a utilização de ativos recuperados internacionalmente tem sido um meio de salvaguardar este direito das vítimas e até que ponto a sua tutela assume preponderância e efetividade quando se trata de partilhar internacionalmente, distribuir e restituir os ativos provenientes da atividade criminosa. A análise implica analisar a racionalidade do direito das vítimas à luz da teoria política dos direitos humanos e a sua evolução histórica, de forma a encontrar novas soluções; - “Human Rights in International Relations: Protection of Victims and Recovery of Assets” Abstract: The subject of this dissertation is the right of victims of crimes, especially human trafficking, to be compensated for damages suffered in light of human rights, public international law, and relations between states. The aim is to characterise the nature of this right, analyse its international regulatory framework and relations between states on the subject, identifying any entropies and ways to overcome them. It will attempt to understand whether the use of internationally recovered assets has been a means of safeguarding this right of victims and to what extent its protection is predominant and effective when it comes to sharing internationally, distributing and returning assets derived from criminal activity. The analysis involves examining the rationale behind victims' rights in light of political theory on human rights and their historical evolution, with a view to finding new solutions.
