O (necessário) alinhamento entre Políticas Públicas e Lei: o caso concreto da medida de acolhimento familiar em Portugal

Abstract

Esta investigação explora a dependência e complementaridade existente entre leis e políticas públicas. Para isso, é analisado o papel fundamental que as políticas públicas desempenham na aplicação da lei de proteção de crianças e jovens em perigo, mais concretamente, na medida de acolhimento familiar em Portugal. A questão central que orienta esta investigação é: como se explicam os números reduzidos de crianças e/ou jovens em acolhimento familiar num país que se afirma como comprometido com a desinstitucionalização? Esta investigação pretende assim contribuir para uma compreensão aprofundada do acolhimento familiar em Portugal enquanto política pública orientada para a desinstitucionalização de crianças e jovens em risco, com foco sobre a análise da experiência recente e desafios. Constituem-se assim, como objetivos específicos: (i) apresentar a evolução socio-histórico-legal e situação atual de implementação da medida de acolhimento familiar em Portugal, com foco nos principais marcos regulatórios à escala supranacional e legislativos à escala nacional; (ii) identificar e descrever eventuais desafios e lacunas existentes na implementação da medida de acolhimento familiar a partir da experiência e voz das instituições de enquadramento (IES) que, diariamente, executam o acolhimento familiar; (iii) traçar o perfil das famílias de acolhimento (FA) em Portugal Continental A metodologia adotada combina uma análise documental e recolha de dados empíricos através de um inquérito por questionário aplicado às instituições de enquadramento que operacionalizam a medida de acolhimento familiar. Esta investigação adota, assim, uma abordagem de investigação mista, conciliando métodos qualitativos e quantitativos para obter uma visão mais ampla e rigorosa sobre a medida de acolhimento familiar. A pesquisa realizada evidencia uma lacuna entre a legislação e a sua aplicação consistente. Os resultados indicam a necessidade de maior coerência e integração entre as leis e as políticas públicas para alcançar a eficácia desejada e cumprir os objetivos governamentais. Este estudo defende uma abordagem holística, coordenada e monitorizada, que supere as inconsistências e assegure a implementação uniforme dos princípios da medida, promovendo de forma eficaz os direitos e a proteção das crianças e jovens em risco; - The (necessary) alignment between Public Policies and Law: the case of the Foster Care Measure in Portugal Abstract: Throughout this study, the dependency and complementarity between laws and public policies are examined. Specifically, the fundamental role that public policies play in implementing the legal framework for the protection of children and youg people at risk is nalyzed, focusing on the foster care measure in Portugal. The central research question guiding this study is: how can the low numbers of children in foster care be explained in a country that claims to be committed do deinstitutionalization? This research aims to contribute to a deeper understanding of foster care in Portugal as a public policy designed to promote deinstitutionalization of childer at risk The specific objectives of this study are: (i) to present the socio-historical-legal evolution and the current state of implementation of the foster care measure in Portugal, with a focus on the main supranational regulatory milestones and national legislative frameworks; (ii) to identify and describe potential challenges and gaps in the implementation of foster care based on the experiences and voices of the institutions (IES) that implement foster care daily; (iii) to outline the profile of foster families (FA) in mainland Portugal. The methodology adopted includes documentary analysis and data collection through a questionnaire survey applied to the institutions that carry the foster care measure. This study employes a mixed-methods reseacr approach, combining qualitative and quantitative strategies to achieve a more comprehensive understanding of the foster care system in Portugal. The research highlights a gap between legislation and its consistent application. The results indicate the need for greater coherence and integration between laws and Public Policies to achieve the desired effectiveness and meet governmental objectives. This dissertation advocates for a holistic, coordinated, and monitored approach to overcome inconsistencies and ensure the uniform implementation of the measure's principles, effectively promoting the rights and protection of children and young people at risk.
