O estado plurinacional e os direitos humanos na America Latina: a propósito dos casos da Bolívia e do Equador

Abstract

O presente trabalho tem como principal objetivo analisar as recentes experiências plurinacionais na Bolívia e no Equador à luz dos direitos humanos. Desta forma, o presente trabalho pretende investigar o surgimento e desenvolvimento do modelo de Estado Plurinacional na América Latina, analisando especialmente de que maneira as constituições plurinacionais da Bolívia e do Equador promovem e asseguram os direitos humanos. Neste sentido o presente trabalho foi dividido em três partes. A primeira parte trata do surgimento do modelo de Estado Plurinacional na América Latina, apontando as suas principais características e analisando o processo de construção deste modelo no contexto histórico do Equador e da Bolívia. A segunda parte do trabalho trata da relação entre o Estado Plurinacional e os direitos humanos, analisando a evolução da proteção dos direitos humanos na América Latina, bem como a forma na qual os direitos humanos são assegurados pelas constituições plurinacionais do Equador e da Bolívia. Por fim, a terceira parte do trabalho trata dos efeitos e dos dilemas do Estado Plurinacional, analisando as principais críticas ao modelo, bem como avaliando os progressos alcançados nos contextos do Equador e da Bolívia em termos de proteção aos direitos humanos, principalmente nos anos posteriores a promulgação das constituições plurinacionais; Abstract: This study aims to analyze the recents plurinational experiences in Ecuador and Bolívia in terms of human rights. ln this way, this study intends to investigate the emergence and development of the model of the Plurinational State in Latin America, analyzing, particularly, how the plurinational constitutions of Bolívia and Ecuador promote and guarantee human rights. ln this way the present study has been divided into three parts. The first part deals with the emergence of the Plurinational State model in Latin American, highlighting its main characteristics and analyzing the process of construction of this model in the historical context of Ecuador and Bolívia. The second part points out the link between human rights and the Plurinational State, analyzing the evolution of the protection of human rights in Latin America, as well as how the human rights are ensured by the plurinational constitutions of Ecuador and Bolívia.Finally, the third part of this study deals with the effects and dilemmas of the Plurinational State, analyzing the main criticisms of the model, as well as evaluating the progress of Ecuador and Bolívia in terms human rights protection, especially after the promulgation of the plurinational constitutions.
