Desejos previamente expressos: Perspectivas dos profissionais de saúde

Abstract

Na Convenção dos Direitos do Homem e da Biomedicina, no Artigo 9°, lê-se que “os desejos previamente expressos, relativamente a uma intervenção médica, por um paciente que não esteja, no momento da intervenção, em condições de exprimir a sua vontade, deverão ser tidos em consideração”. Com o nosso trabalho queremos conhecer a opinião dos profissionais de saúde (enfermeiros e médicos) sobre este Artigo, pouco falado em Portugal. Os fundamentos da construção dessas vontades são observados do lado dos doentes (informação, autonomia e consentimento informado) e do lado dos profissionais de saúde (princípios éticos e deveres deontológicos). Vislumbrámos limitações à implementação deste direito e face à emergência de legislação que considera esta questão, fazemos uma curta observação das leis dos Estados Unidos e dos vários países europeus onde já se encontra contemplada. Realizámos um estudo qualitativo num departamento de pneumologia de um hospital central de Lisboa junto dos enfermeiros e dos médicos. Através das 14 entrevistas semiestruturadas, conseguimos dados que nos permitiram concluir que os profissionais consideram pertinente que seja dada ao doente oportunidade de expressar a sua vontade sobre cuidados de saúde para que seja seguida quando já não se encontra em condições de decidir. Simultaneamente, identificam atitudes dos profissionais de saúde e dos doentes que dificultam a sua implementação como o défice de informação dada e pedida, o défice de autonomia observado nos doentes portugueses e a dificuldade em abordar questões de fim de vida pelos intervenientes (profissionais e doentes). Distinguem-se as sugestões de debate e de formação como intervenções sócio organizacionais vindas dos profissionais que constituem a base de um plano de mudança a implementar na instituição onde se realizou o estudo. /ABSTRACT - ln the Convention on Human Rights and Biomedicine, in the Article 9, is read that “the-previously expressed wishes relating to a medical intervention by a patient who is not, at the time of the intervention, in a state to express his or her wishes shall be taken into account.” With our work, we want to know the opinion of the health professionals (nurses and doctors) on this Article, that’s not very spoken in Portugal. We establish the construction of these wills from the side of the patients (information, autonomy and informed consent) and from the side of the health professionals (ethical principles and deontological duties). We glimpsed the limitations of the implementation of this right and look at the legislation that emerge and contemplates this question, in the United States and in several Europeans countries where the law is already contemplated. Through a quality study in a department of pneumology of a central hospital in Lisbon, we question nurses and doctors about the topic of discussion. With 14 interviews, we collect facts that allow us to conclude that the professionals think that is pertaining for the patient to have the opportunity to express his/her wishes relating to medical cares, which will be followed when his/her is unable to decide (advance directives). Simultaneously, we identify attitudes of the health professionals and of the patients that difficult the implementation of advance decisions, like the deficit of information asked and given, the deficit of autonomy observed in the Portuguese patients and the difficult of talk about the end of life questions. ln the suggestions made by the health professionals, stand out the debate and the formation about the subject like interventions socio-organizational, that will be the base of a plan of changing in the institution where we made the study.
